The Department of Defense announced that three men accused of plotting the 11 September 2001 attacks on the US have reached a pre-trial agreement. Khalid Sheikh Mohammed, Walid Muhammad Salih Mubarak Bin Attash, and Mustafa Ahmed Adam al-Hawsawi, who have been held at the US Navy base at Guantanamo Bay for years without trial, will plead guilty in exchange for the prosecution not seeking the death penalty.

Nearly 3,000 people were killed in New York, Virginia, and Pennsylvania during the attacks, which led to the “War on Terror” and the invasions of Afghanistan and Iraq. Khalid Sheikh Mohammed is considered the mastermind of the attacks, where hijackers seized passenger planes and crashed them into the World Trade Center and the Pentagon. A fourth plane crashed into a Pennsylvania field after passengers fought back.

The plea deal was first announced in a letter to the families of victims. The specifics of the agreement are not yet public. The trial has been delayed partly due to concerns that evidence obtained through “enhanced interrogation techniques,” such as waterboarding, could be deemed inadmissible.

Jim Smith, whose wife died in the attacks, expressed disappointment, stating that the families “waited 23 years to have our day in court.” Senate Minority Leader Mitch McConnell condemned the deal as an abdication of the government’s duty to provide justice, criticizing the Biden administration’s involvement.
